本學期將介紹國家法I (Staatsrecht I) : 憲法的基礎理論和國家機關組織。

This semester will introduce State Law I (Staatsrecht I): the basic theory of the constitution and the organization of state organs.

介紹中華民國憲法的發生背景、意義及其在總體法律上的地位，再認識什麼是「法律母法」。
本課程內容主要為中華民國憲法的發生背景、意義及其在憲政上的地位。分別就下列十個重點進行課程講授及研討，即：1.國體、政體、主權、領土、國民之規範。2.憲政發展史。3.人民之基本權利與義務及重要國際人權公約，二十一世紀人權新發展趨勢4.釋憲制度與人權及憲政之維護。5.中央政制。6.地方制度。7.均權制度。8.我國之基本國策。9.歷次憲法修正重點。10.憲改的界限及努力方向。11.修憲後政府再造之批判。

Introduce the background and significance of the Constitution of the Republic of China and its status in the overall law, and then understand what the "parent law" is.
The content of this course is mainly about the background, significance and status of the Constitution of the Republic of China in constitutional government. Course lectures and discussions will be conducted on the following ten key points, namely: 1. National system, political system, sovereignty, territory, and national norms. 2. History of the development of constitutional government. 3. The basic rights and obligations of the people and important international human rights conventions, and the new development trends of human rights in the 21st century. 4. The system of constitutional interpretation and the maintenance of human rights and constitutional government. 5. Central political system. 6. Local system. 7. Equal rights system. 8. Our country’s basic national policy. 9. Key points of previous constitutional amendments. 10. The limits and directions of efforts for constitutional reform. 11. Criticism of government reinvention after the constitutional amendment.
