教育目標 Course Target
於修課學生已具備民法總則、民法債編通則之概念基礎上，本課程進一步針對「各種之債」一章中所列之有名契約進行介紹。除依序就個別要件及其實質意涵進行說明外，亦將適時針對其間之重要法律爭議為引介。對此除補充學理上所提出之各方見解外，另將整理相關實務裁判，俾修課學生得以具體掌握學說與實務對於爭議問題之切入點為何，由全面的視角來認識不同有名契約之面貌，以強化其思考法律問題與解決實際案例之能力。
In view of the conceptual basis of the general civil law and the general civil law debts of the course, this course further introduces the famous contracts listed in the chapter "A variety of debts". In addition to explaining the individual requirements and their actual meanings in sequence, important legal disputes over them will also be introduced at appropriate times. In addition to supplementing the various opinions raised in the academic field, relevant practical referees will be organized so that students can specifically grasp the entry point of academic and practical issues on disputes, and understand the appearance of different famous contracts from a comprehensive perspective to enhance their ability to think about legal issues and solve actual cases.
