Civil Law: Kinds of Obligations
教育目標 Course Target
於修課學生已具備民法總則、民法債編通則之概念基礎上，本課程進一步針對「各種之債」一章中所列之有名契約進行介紹。除依序就個別要件及其實質意涵進行說明外，亦將適時針對其間之重要法律爭議為引介。對此除補充學理上所提出之各方見解外，另將整理相關實務裁判，俾修課學生得以具體掌握學說與實務對於爭議問題之切入點為何，由全面的視角來認識不同有名契約之面貌，以強化其思考法律問題與解決實際案例之能力。
On the basis that students already have the concepts of the General Principles of Civil Law and the General Principles of Civil Law on Obligations, this course further introduces the famous contracts listed in the chapter "Various Debts". In addition to explaining the individual elements and their substantive meanings in sequence, the important legal disputes involved will also be introduced in a timely manner. In addition to supplementing the theoretical opinions of various parties, the relevant practical judgments will also be sorted out, so that students in the course can specifically grasp the entry points of doctrine and practice on disputed issues, understand the aspects of different well-known contracts from a comprehensive perspective, and strengthen their ability to think about legal issues and solve practical cases.
