講述行政法的基本理論,包括基本概念、行政組織、行政作用法及行政救濟法。除此之外,並挑選實務指導學生蒐集、整理、分析、歸納當前行政法制運作缺失及其改善途徑。本課程主要內容為:1.行政法之意義、種類、性質、效力、基本原則。2.行政組織法、公務員法、公物法。3.行政作用法—行政規章、行政處分、行政契約、行政計畫、行政處罰、行政執行。4.行政救濟法—訴願、行政訴訟、國家賠償、國家補償。5.行政法新發展趨勢。並藉理念的分析與現行制度運作之剖析,提出相關批判與改進之建議。
Describe the basic theories of administrative law, including basic concepts, administrative organization, administrative role law and administrative economic relief law. In addition, we will select and guide students to collect, organize, analyze and learn about the current lack of administrative and legal system operations and their ways to improve them. The main contents of this course are: 1. The meaning, type, nature, effectiveness and basic principles of administrative law. 2. Administrative Organization Law, Public Affairs Law, and Public Property Law. 3. Administrative Function Law—Administrative Rules, Administrative Divisions, Administrative Contracts, Administrative Planning, Administrative Rules, Administrative Implementation. 4. Administrative Economic Rescue Law—claim, administrative lawsuit, national compensation, national compensation. 5. New trends in development of administrative law. And through the analysis of concepts and the analysis of current system operations, we put forward relevant criticism and improvement suggestions.
本課程不指定教科書,以上課講義為主。
但是強烈建議各位同學到書店找一本「自己讀得下去的」行政法「教科書」作為輔助教材。第一次學習行政法,不太建議直接使用補習班的教材。
