Civil Law: Kinds of Obligations
教育目標 Course Target
於民法總則、民法債編總則之基礎上，本課程進一步針對各種之債的具體規範內容進行介紹。除依序說明各有名契約之要件及其概念內涵外，亦將適時針對其間之重要法律爭議為說明，補充學理上對此提出之各方見解、並就相關實務裁判進行討論，以具體觀察學說與實務對於爭議問題之切入點為何，俾學生得由全面的視角來認識不同有名契約之面貌，以強化其思考法律問題與解決實際案例之能力。
Based on the General of Civil Law and General of Civil Law Debt Encoding, this course further introduces the specific regulations of various debts. In addition to explaining the requirements and conceptual connotations of each famous contract in sequence, it also provides appropriate explanations of important legal disputes among them, supplementing the theoretical explanations of the parties proposed here, and discussing relevant practical judges, so that students can understand the appearance of different famous contracts from a comprehensive perspective to enhance their ability to think about legal problems and solve actual cases.
