刑法乃規定犯罪及法律效果之刑罰的關係之行為規範，而刑法總則為刑法規定共同適用之準則，亦為研習刑事法之基礎，其於犯罪之基本觀念及刑罰之終極目的，在理論方面固值作深入之比較研究，而在實際運用上，尤須注意其妥適性。
