本課程目的主要在於建立學生基本的國際私法理論概念、協助學生思考並培養解決國際私法問題之能力。針對大四學生,採用「立體化」的法律教學概念:即連結點、線、面的理論基礎,輔以司法實務高度作為整體國際私法「建築」概念之方式(一堂至少一個法院判決案例討論)。不但計畫在理論的縱深上詳細說明各項概念,並且期待能培養學生面對未來涉外實務細節時,能具備有系統的思考能力。The purpose of this course is mainly to establish students' basic concepts of international private legal theory, help students think and cultivate their ability to solve international private legal problems. For senior students, the concept of "three-dimensional" legal teaching is adopted: that is, the theoretical basis of connecting points, lines and surfaces, and the concept of "architecture" in the overall international private law is based on the height of judicial practice (discussion of at least one court judgment case). Not only does the plan explain the concepts in depth in the theoretical discussion, but it also hopes to cultivate students to have systematic thinking ability when facing the detailed foreign-related practices in the future.
本課程介紹有關涉外民事問題之解決辦法,除討論我國涉外民事問題之解決辦法外,並研究其他國家關於涉外問題之解決辦法。
This course introduces solutions to foreign-related civil issues. In addition to discussing solutions to foreign-related civil issues in our country, it also studies solutions to foreign-related problems in other countries.
