近年兩岸人民交流益加頻繁，但兩岸對涉及私法的區際法律衝突的處理方式未必一致、判決未必相互承認與執行，此將影響兩岸人民權利義務甚钜。藉由兩岸區際私法之制度研究與學術交流，減少法律衝突、避免規避法律、濫擇法庭、加強司法互助，追求兩岸共榮之願景，實乃不可或缺。台灣在2010年五月底，甫公佈五十七年來首次「涉外民事法律適用法」之修正，預計於2011年五月底施行。大陸在2010年十月底，也通過了首部「涉外民事關係法律適用法」，而預計於2011年4月1日施行。因此，針對大陸首部國際私法之成文立法進行深刻分析，進而與台灣原有之台灣地區與大陸地區人民關係條例、修正涉外民事法律適用法等立法趨勢之比較分析，實屬兩岸經貿往來與人民權利保護所不可或缺之研究。In recent years, exchanges between people on both sides of the Taiwan Strait have become increasingly frequent. However, the two sides of the Taiwan Strait may not necessarily handle interregional legal conflicts involving private law in the same way, and judgments may not necessarily be recognized and enforced by each other. This will greatly affect the rights and obligations of people on both sides of the Taiwan Strait. Through institutional research and academic exchanges on interregional private law across the Taiwan Strait, it is indispensable to reduce legal conflicts, avoid legal circumvention, arbitrary court selection, strengthen judicial mutual assistance, and pursue the vision of common prosperity across the Taiwan Strait. At the end of May 2010, Taiwan announced the first amendment to the "Law on the Application of Foreign-Related Civil Laws" in 57 years, which is expected to be implemented at the end of May 2011. At the end of October 2010, mainland China also passed its first "Law on the Application of Laws to Foreign-Related Civil Relations", which is expected to be implemented on April 1, 2011. Therefore, an in-depth analysis of mainland China’s first written legislation on private international law, and a comparative analysis with Taiwan’s original legislative trends such as the Ordinance on Relations between the People of the Taiwan Area and the Mainland Area and the Amended Law on the Application of Foreign-Related Civil Laws, is indeed a cross-strait economic and trade exchange and people’s rights. Research indispensable for conservation.
