本課程之目標，係在探討刑法總則中，各項應適用於刑法分則以及其他相關刑事法令之共通原理。刑法總則規範犯罪行為之一般要件與法律效果，據以建立判斷是否成立犯罪與應否科處刑罰之體系。The goal of this course is to explore the common principles in the general principles of criminal law that should be applied to the sub-principles of criminal law and other related criminal laws. The General Principles of Criminal Law regulate the general requirements and legal effects of criminal acts, and establish a system for judging whether a crime has been established and whether a crime should be punished.
刑法乃規定犯罪及法律效果之刑罰的關係之行為規範，而刑法總則為刑法規定共同適用之準則，亦為研習刑事法之基礎，其於犯罪之基本觀念及刑罰之終極目的，在理論方面固值作深入之比較研究，而在實際運用上，尤須注意其妥適性。
Criminal law is a code of conduct that stipulates the relationship between crimes and legal effects of punishment. The general principles of criminal law are the standards for common application of criminal law provisions and are also the basis for studying criminal law. They are theoretically solidified in the basic concepts of crime and the ultimate purpose of punishment. It is worthy of in-depth comparative study, and in practical application, special attention must be paid to its appropriateness.
