本課程是學習刑法之通論,亦是接下來學習刑法分則之前,必須先有通盤認識的課程。由於刑法總則的理論非常抽象,初學者往往因無法確實掌握,而容易產生挫折,故本課程以連貫及活潑之教學方法,將學生引導至理解刑法及喜愛刑法之學習效果,即嘗試讓學生以輕鬆的心情,進入學習刑法的大門。課程中並輔以圖表及實際案例解說之方式,教導學生思考學習刑法的目的及解決問題的方法,使學生能夠從中獲得學習的樂趣與效果,以期學生能夠掌握刑法總責的理論並加以運用。This course is a general discussion of the Criminal Law, and it is also a course that must be fully aware of before learning the Criminal Law. Since the theory of the Criminal Law is very abstract, beginners are often prone to setbacks because they cannot master it correctly. Therefore, this course uses a combination of teaching methods to guide students to the learning effect of understanding criminal law and liking criminal law, that is, try to let students enter the door of learning criminal law with a relaxed mood. During the course, students are taught to think about the purpose of learning criminal law and the methods of solving problems through charts and actual cases, so that students can gain the fun and effect of learning, so that students can master the theories of the Criminal Law and use them.
刑法乃規定犯罪及法律效果之刑罰的關係之行為規範,而刑法總則為刑法規定共同適用之準則,亦為研習刑事法之基礎,其於犯罪之基本觀念及刑罰之終極目的,在理論方面固值作深入之比較研究,而在實際運用上,尤須注意其妥適性。
