本課程之教學目標為以下兩點：1.探討法的本質與法律制度中正義的理論。2.探討司法院大法官之憲法解釋論。主要內容係就立法與裁判等角度，思考法的制度與理論。具體的內容包括法的種類、效力與強制、法源論、權利論、法解釋論、法正義論、法政策論等項目。

The teaching objectives of this course are the following two points: 1. To explore the nature of law and the theory of justice in the legal system. 2. Discuss the interpretation theory of the Constitution by the Justices of the Judicial Yuan. The main content is to think about the system and theory of law from the perspectives of legislation and adjudication. Specific contents include types of law, effectiveness and coercion, theory of the origin of law, theory of rights, theory of legal interpretation, theory of legal justice, theory of legal policy, etc.

本學科目的：協助學生研究現代法律系統的構造及其精神。 授課內容：法思想史、法理學各論（法本質論、法價值論、法學方法論）。授課方式：用講述方法，並按研究問題之性質指定參考資料。

The purpose of this subject: to assist students in studying the structure and spirit of the modern legal system. Teaching content: History of legal thought, various treatises on jurisprudence (theory of legal essence, legal value theory, legal methodology). Teaching method: Use narrative method, and specify reference materials according to the nature of the research problem.
