Case Studies on Criminal Law
教育目標 Course Target
本課程以刑事案例為基礎，就案例涉及的刑事實體法及刑事程序法問題，進行理論研析及檢討。在刑事實體法的部分，討論法院判決在個案的刑法適用，或法院先後見解的歧異，重點在於探究個案上犯罪論斷的疑難。在刑事程序法的部分，主要是觀察司法實務運作上，上級審法院對於下級審法院程序違誤的指正，或辯護人提出的程序爭執，思考刑事程序如何符合正當法律程序的要求，進而求取真實發現與人權保障的平衡。總體來說，本課程是在刑事法的理論與實務之間，來回關照。
This course is based on criminal cases and conducts theoretical analysis and review of the criminal substantive law and criminal procedural law issues involved in the case. In the part of criminal substantive law, the application of criminal law in court decisions in individual cases or the differences in opinions of courts are discussed, focusing on exploring the difficulties in criminal judgment in individual cases. In the criminal procedure law section, we mainly observe the operation of judicial practice, including the correction of procedural errors by the superior court on the procedural errors of the lower court, or the procedural disputes raised by the defender, and consider how the criminal procedure meets the requirements of due legal process, and then seek a balance between true discovery and human rights protection. Generally speaking, this course is a back-and-forth between the theory and practice of criminal law.
