本課程旨在引導學生認識西方法律傳統的歷史發展，並理解現代法律制度背後的歷史脈絡與思想基礎。西方法律的根源可追溯至羅馬法，其制度與觀念對後世歐洲各國法律發展具有決定性影響，尤其深植於今日大陸法系/市民法體系國家當中。課程內容將以羅馬法為出發點，介紹羅馬法如何在中世紀透過大學的法學教育體系得以「復興」與「繼受」，並對近代歐陸各國，特別是德意志地區，產生深遠影響。課程將聚焦於私法發展的歷史軌跡，從中世紀開始，一直到德國民法典（BGB）的制定，並進一步探討對於台灣之影響。透過歷史的視角，學生將能建立對私法史與比較法的基本認識，並理解今日法律與法理背後所蘊含的歷史因素與思想基礎，深化對於實定法以及法律基礎的理解。

This course aims to guide students to understand the historical development of Western legal traditions and understand the historical context and ideological foundation behind the modern legal system. The roots of Western law can be traced back to Roman law, and its systems and concepts have had a decisive influence on the legal development of subsequent European countries, especially in countries with today's civil law/civil law systems. The course content will take Roman law as the starting point and introduce how Roman law was "revived" and "inherited" through the university's legal education system in the Middle Ages, and had a profound impact on modern European countries, especially the German region. The course will focus on the historical trajectory of the development of private law, starting from the Middle Ages to the formulation of the German Civil Code (BGB), and further explore its impact on Taiwan. Through a historical perspective, students will be able to establish a basic understanding of the history of private law and comparative law, understand the historical factors and ideological foundations behind today's laws and legal principles, and deepen their understanding of positive law and legal foundations.
