教育目標 Course Target

授課人在教學現場觀察到一個奇妙的現象,亦即「老師的教學受有非常高度評價」,而且「學生們具有高度學習參與與學習動機」但卻仍然只有「低度學習成效」的產出。這個觀察,顯然是反於一般論所認知的常識,而此一反常現象,便促使授課人欲深入著手研究。為此,授課人以「以『排除跨課程系統性學習障礙』為目的之『融貫式槓桿課程』對法律系學生高階能力養成之有效性研究」為題申請教育部教學研究計畫並獲通過(PSL1090132,下稱109實踐研究)。經109實踐研究實證發現,系統性學習障礙之最顯著病徵,體現在學生們(全部履修者,不論年級)皆有一個共同的學習盲點,亦即,只要面對嶄新劇情的實例題就無法看出爭點。換言之,他們只能解決課堂上已經講授過之一模一樣的實例題。然而,司律之國考考題在設計上,理所當然必含有大一刑法總則與大二刑法分則的諸多考點,係將之融合後所嶄新設計的實例題。學生們初見該實例題,往往不知該從何著手加以解題。然事實上,解答該國考考題所需運用的法理,其實在刑法總則與刑法分則之課堂上應該已然學過。而之所以學生們普遍上仍然有完全不知從何著手加以解題之情形,此點,透過109實踐研究之結果可知,導致此一情形之學習障礙有二,其一,學生們對於刑法分則之理解多數係流於零碎片段之死記硬背,其二,渠等多數存在有跨年級的系統性學習障礙,亦即完全無法自行將大一刑總與大二刑分之所學內容予以融會貫通。為此,授課人特開設本課程,擬在刑法總則之底蘊上,以刑法分則為架構,設計體系式之案例研究與實作課程,來克服前揭兩項學習障礙。具體上,所設定分為「個人法益」、「社會法益」與「國家法益」三章節,在刑法總則犯罪三階段論證之基礎上,以「法益論」與「條文解釋適用」為體系建構重點,於此之上進行「案例解析」之方法論講授、解題示範與例題實作演練。

The instructor observed a wonderful phenomenon at the teaching site, that is, "teachers' teaching is highly praised" and "students are highly engaged and motivated" but still only produce "low learning effectiveness". This observation is obviously contrary to the common sense recognized by general theory, and this anomaly prompted the lecturer to conduct in-depth research. To this end, the lecturer applied for the Ministry of Education’s Teaching Research Program with the title of “Research on the Effectiveness of ‘Coherent Leveraged Curriculum’ for the Purpose of ‘Eliminating Cross-Curriculum Systemic Learning Barriers’ in Cultivating Higher-Order Abilities of Law Students” and was approved (PSL1090132, hereinafter referred to as 109 Practical Research). Through 109 practical studies, it has been found that the most obvious symptom of systemic learning disabilities is that students (all students, regardless of grade) have a common learning blind spot, that is, they cannot see the point of contention as long as they face the example questions of the new plot. In other words, they can only solve the same example problems that have been taught in class. However, in the design of the national examination questions for judicial officers, it is natural that they must contain many test points from the general principles of criminal law for the freshman year and the specific principles of criminal law for the sophomore year. They are newly designed example questions after integrating them. When students first see this example problem, they often don’t know where to start to solve it. However, in fact, the legal principles needed to answer the country's examination questions should have been learned in the class of General Principles of Criminal Law and Special Principles of Criminal Law. The reason why students generally still have no idea where to start to solve problems is because, through the results of 109 practical research, it can be seen that there are two learning obstacles that lead to this situation. First, most students’ understanding of criminal law principles is based on rote memorization of fragments. Second, most of them have systemic learning difficulties across grades, that is, they are completely unable to integrate what they have learned in freshman criminal law and sophomore criminal law. For this reason, the instructor has specially created this course, which intends to design a systematic case study and practical course based on the general principles of criminal law and the sub-principles of criminal law as a framework to overcome the two learning obstacles mentioned above. Specifically, it is divided into three chapters: "Personal Legal Interests", "Social Legal Interests" and "National Legal Interests". Based on the three-stage argumentation of the general principles of criminal law, "Legal Interest Theory" and "Interpretation and Application of Provisions" are the focus of system construction. Based on this, methodological teaching, problem-solving demonstrations and practice exercises of "Case Analysis" are carried out.
