法理學是一門探討「什麼是法律」、「法律之正當性」、「法律與道德倫理、社會、政治經濟之關係為何」以及「法律背後的哲學與邏輯」的學問。本課程首先以思想史的脈絡出發，從古希臘羅馬自然法思想、中世紀基督教法思想，到近代社會契約論、啟蒙時期的法哲學，循序介紹思想脈絡如何塑造法律背後的原理原則。接著會介紹當代英美分析法理學以及歐陸法哲學思想，讓學生了解當前法理學的樣貌以及討論議題。透過不同時代以及不同流派的思想，引導學生去思考法學背後的思想與理論。

Jurisprudence is a discipline that explores "what is law", "the legitimacy of law", "the relationship between law and moral ethics, society, and political economy" and "the philosophy and logic behind law". This course first starts from the context of intellectual history, from ancient Greek and Roman natural law thought, medieval Christian legal thought, to modern social contract theory and the legal philosophy of the Enlightenment period, and sequentially introduces how the ideological context shapes the principles behind the law. Then, contemporary British and American analytical jurisprudence and European continental legal philosophy will be introduced, allowing students to understand the current appearance of jurisprudence and discussion issues. Through ideas from different eras and schools, students are guided to think about the ideas and theories behind law.
