台灣民法所主要繼受的德國民法與瑞士民法，乃深受十九世紀德語法學圈「學說編纂學」(Pandektistik) 所影響；而學說編纂學則是對自然法學派所引發的法典化運動的回應。無論哪個學派，其內容皆以羅馬法文本為主要的詮釋起點。即使是英美法系的普通法，也深受羅馬法的重要影響。因此，在進行民法的比較研究時，羅馬法相關知識可提供極大的助力。本課程將以閱讀 Zimmermann 的 The Law of Obligations 為主軸，以羅馬法為出發點，挑選債法領域中的幾個重要主題，透過歷史的脈絡理解不同國家的制度異同。

The Taiwan Civil Law Institute mainly inherited German civil law and Swiss civil law, which were deeply influenced by the "doctrinal codification" (Pandektistik) of the German grammatical circle in the 19th century. Pandektistik was a response to the codification movement triggered by the natural law school. No matter which school of thought, its content is based on the text of Roman law as the main starting point for interpretation. Even the common law of the common law system is deeply influenced by Roman law. Therefore, when conducting comparative research on civil law, knowledge about Roman law can provide great assistance. This course will focus on reading Zimmermann's The Law of Obligations, take Roman law as the starting point, select several important topics in the field of debt law, and understand the similarities and differences of the systems of different countries through the historical context.
