法學方法論不僅關乎到如何進行法律論證以及如何認事用法，在法之續造時亦扮演重要的角色。本課程以我國繼受德國法學傳統為背景，分為兩大部分進行。第一部分解說 19 世紀以來的德國法學，介紹從歷史法學派、學說編篡學（Pandektistik）、利益法學、評價法學等各階段法學思想帶來的方法論變遷，並說明這些理論如何影響到我國法律，特別是民法相關的論證方式與思考方式。第二部分則聚焦於不同解釋方法在我國法律制度中的實際運用。課程將探討文義、體系、歷史與目的解釋等基本解釋方法如何運用在具體事例中，並且討論法律漏洞的不同填補方式。透過判決、案例討論與方法論比較，學生將學習如何在具體法律問題中提出論證、推論以及解釋法律。

Legal methodology is not only related to how to conduct legal arguments and how to recognize things and apply laws, but also plays an important role in the continued creation of law. This course is based on the background of my country's inheritance of German legal tradition and is divided into two parts. The first part explains German jurisprudence since the 19th century, introducing the methodological changes brought about by legal thought at various stages such as the historical school of law, doctrine compilation (Pandektistik), interest law, and evaluative law, and explains how these theories affect our country's law, especially the way of argumentation and thinking related to civil law. The second part focuses on the practical application of different interpretation methods in our country's legal system. The course will explore how basic interpretation methods such as literal meaning, system, history and purpose interpretation are applied in specific cases, and discuss different ways of filling legal loopholes. Through judgments, case discussions, and methodological comparisons, students will learn how to present arguments, inferences, and interpret the law in specific legal issues.
