教育目標 Course Target
本課程以立憲主義之目的—保障人權為核心,延續上學期所介紹憲法之基本原理、基本權保障體系及國家組織架構,目的在於引導學生理解憲法作為民主法治國家最高規範之功能與意義,並培養學生以憲法觀點分析公共議題與法律爭議之能力。
課程前半段首先說明憲法的基本原理與原則,包括憲法的規範性、最高性及拘束力,並建立基本權保障之整體架構。在此基礎上,介紹基本權總論,說明基本權之性質、功能與限制,並以自由權之違憲審查為核心,講授比例原則、法律保留原則及審查密度等重要概念,使學生能掌握違憲審查的基本方法。進入基本權各論後,課程將依序探討人身自由、行動自由、思想及表現自由、秘密通訊自由、宗教自由與集會結社自由等自由權類型。除介紹各項基本權之保障範圍與憲法意義外,並輔以重要釋憲實務與案例,說明國家得以何種方式與界限加以限制,並引導學生運用比例原則與憲法價值進行具體分析。
在社會權部分,課程將介紹生存權、工作權與財產權之憲法定位,說明社會權在保障人民基本生活條件與維護公共利益間所扮演的角色,並討論社會權是否具備主觀公權利性質、國家給付義務之範圍,以及相關爭議議題,如死刑、安樂死、墮胎、勞動權保障與財產權限制等。
此外,課程亦將說明訴訟權、應考試服公職之權與參政權等程序性與政治性基本權,使學生理解民主憲政國家中人民參與公共事務、實現權利救濟與監督國家權力之制度基礎。並介紹憲法第22條其他基本權及國家責任理論,使學生理解憲法保障並不限於明文列舉之權利。
在國家組織論部分,課程將說明現代國家組織的基本理論與權力分立原則,並介紹我國中央政制之特色,包含總統、行政院、立法院及司法院之地位、職權配置與相互制衡關係,特別著重司法權之性質、司法獨立及法官中立原則與司法審查之憲法意義。
本課程將視學生背景、學習需求與課堂理解狀況,配合教學資源與實際授課情形,對授課重點與案例素材作適度調整。在相關單元中,並輔以日本憲法判例與制度實務之比較說明,協助學生透過比較法視角理解基本權保障與國家權力運作之多元模式,強化對我國憲法制度之反思能力。
課程後段配合自主學習週設計法院參訪,透過實務觀察引導學生將課堂所學之基本權保障與國家組織理論,連結至司法實際運作情形,並透過心得撰寫深化對憲法作為生活中可用之法的理解。整體而言,本課程旨在培養學生具備基本的憲法思維能力,能以憲法觀點理解法律制度與公共治理,並建立尊重人權與法治精神的公民素養。
This course focuses on the purpose of constitutionalism - protecting human rights. It continues the basic principles of the constitution, the basic rights protection system and the national organizational structure introduced in the previous semester. The purpose is to guide students to understand the function and significance of the constitution as the highest norm in a democratic and rule-of-law country, and to cultivate students' ability to analyze public issues and legal disputes from a constitutional perspective.
The first half of the course first explains the basic principles and principles of the Constitution, including the normative, supreme and binding power of the Constitution, and establishes an overall framework for the protection of fundamental rights. On this basis, it introduces the general theory of fundamental rights, explains the nature, functions and limitations of fundamental rights, and takes the constitutional review of freedom rights as the core to teach important concepts such as the principle of proportionality, the principle of legal reservation and the density of review, so that students can master the basic methods of constitutional review. After entering each chapter on fundamental rights, the course will sequentially explore types of freedoms such as personal freedom, freedom of movement, freedom of thought and expression, freedom of secret communication, freedom of religion, and freedom of assembly and association. In addition to introducing the protection scope and constitutional significance of various basic rights, it is also supplemented by important constitutional interpretation practices and cases to explain the ways and boundaries in which the state can impose restrictions, and guides students to conduct specific analysis using the principle of proportionality and constitutional values.
In the social rights section, the course will introduce the constitutional positioning of the rights to subsistence, work and property, explain the role of social rights in protecting people's basic living conditions and safeguarding public interests, and discuss whether social rights have the nature of subjective public rights, the scope of the state's payment obligations, and related controversial issues, such as the death penalty, euthanasia, abortion, labor rights protection and property rights restrictions.
In addition, the course will also explain basic procedural and political rights such as the right to litigate, the right to take an examination to serve in public office, and the right to participate in political participation, so that students can understand the institutional basis for people to participate in public affairs, realize rights remedies, and supervise state power in democratic constitutional countries. It also introduces other basic rights in Article 22 of the Constitution and the theory of state responsibility, so that students can understand that the protection of the Constitution is not limited to the rights explicitly listed.
In the section on state organization, the course will explain the basic theory of modern state organization and the principle of separation of powers, and introduce the characteristics of my country's central political system, including the status, allocation of powers and mutual checks and balances of the President, Executive Yuan, Legislative Yuan and Judicial Yuan, with special emphasis on the nature of judicial power, the principles of judicial independence and judge neutrality, and the constitutional significance of judicial review.
This course will make appropriate adjustments to the teaching focus and case materials based on the students' background, learning needs and classroom understanding, in conjunction with teaching resources and actual teaching situations. In relevant units, it is supplemented by comparative explanations of Japanese constitutional jurisprudence and institutional practice to help students understand the multiple models of basic rights protection and state power operation through the perspective of comparative law, and strengthen their ability to reflect on our country's constitutional system.
The latter part of the course cooperates with the independent study week to design a court visit. Through practical observation, students are guided to connect the basic rights protection and state organization theory learned in the classroom to the actual operation of the judiciary, and deepen their understanding of the constitution as a law usable in life through experience writing. Overall, this course aims to cultivate students' basic constitutional thinking skills, understand the legal system and public governance from a constitutional perspective, and establish civic literacy that respects human rights and the spirit of the rule of law.
