7360 - 刑法爭議問題學理與實務
教育目標 Course Target
刑法主要規範的範圍，在於判斷具體行為是否為犯罪，並對於犯罪賦予相對應的法律效果，故其體下架構可以區隔為七大部分:1、基礎理念，如法定原則、罪責原則、無罪推定原則及最後手段原則；2、犯罪行為論，其中包括不法與可罰的判定，重要內容有構成要件體系及犯罪類型刑事責任形成的基礎；3、法律效果論，主要是刑罰、保安處分及沒收；4、競合關係；5、刑罰裁量；6、刑罰的執行；7、時效。本課程主要再從學理的分析與批判，同時透過食物具體運用關西，做深入刑法正確適用檢視與驗證。
The scope of the main scope of the Criminal Law is to judge whether the specific behavior is a crime and to give corresponding legal effects to the crime. Therefore, its removal structure can be divided into seven parts: 1. Basic concepts, such as statutory principles, crime principles, presumption of innocence, and final means principles; 2. Crime Actual discussions, including illegal and punitive judgments, and important contents include the system of structural elements and the basis for criminal responsibility; 3. Legal effect discussions, mainly criminal punishment, security points and incurred; 4. Competitive relationships; 5. Criminal discretion; 6. Implementation of criminal punishment; 7. Time-of-time effect. This course mainly relies on the analysis and criticism of science, and at the same time, through the specific use of food, we will conduct in-depth accurate and appropriate inspection and verification of criminal law.
