教育目標 Course Target
刑事訴訟法主要的任務，是刑事實體法關於犯罪認定與刑罰制裁的實現，是屬於實現性的程序規範，充分理解刑事程序的規則與要求，是確認實體法實現與法治國思想的首要任務。藉由刑事程序的整體性觀察，以及指導原則的闡明，以住學習者能對於刑事程序有更深一層的體認。而爭議問題者，則是對於現制及制度面的總檢討，以期學生能完全掌握刑事訴訟及司法運作的實然與應然。
The main task of the criminal procedure law is to realize the criminal substantive law's determination of crime and penalty sanctions. It is a procedural norm that is implementable. Fully understanding the rules and requirements of criminal procedures is the primary task of confirming the realization of substantive law and the idea of rule of law. Through the overall observation of criminal procedures and the clarification of guiding principles, learners can have a deeper understanding of criminal procedures. As for the controversial issues, it is a general review of the current system and system, so that students can fully grasp the reality and should of criminal proceedings and judicial operations.
