教育目標 Course Target

授課目標:確認醫病的權利義務關係,在法律定位的實然與應然,以使得修習課程者能瞭解醫療所生的法律關係。課程以醫療法為基礎,因醫療所生醫療爭議事件問題的探討,檢視醫療爭議事件發生的原因,檢討醫療事故的法律關係,對於醫療爭議事件所生的責任定性,分析介紹處理醫療爭議事件應有的模式,界以降低醫療爭議事件的紛擾,能使從事醫療工作的醫護人員,安心善守於其醫療的崗位,避免醫療爭議事件造成醫療體系的危機意識。藉以醫療爭議問題的理解,以及其處理模式的掌握,讓醫療層次的發展與提升,能在法律關係上,確認應有的基本認知。
授課內涵:一、醫療的法律關係定性;二、醫病關係與法律責任概述;三、預防性醫療的法律問題;四、病人自主與醫療的平衡關係;五、醫療正當性與風險;六、具體醫療作為的前提及其法律屬性;七、醫療糾紛的成因與現象;八、法律上對於醫療糾紛責任任的機制;九、具體個案分析與處理模式的融合;十、平衡醫療責任的可行性方式;十一、醫療糾紛訴訟與調解方式的剖析;十二、概念與個案融合的綜合研判。
具體授課的內容,係從題綱導入具體應遵循的程序,從醫療行為,不論作為或不作為,採取以案例引導方式,遍及醫療程序SOP的基本要求,諸如告知義務與具體內容、病人自主與醫療專斷問題、醫療臨界的問題、預防性醫療是否為豁免法律責任的保護傘?舉凡醫療所生的諸等問題,儘量於課程及實際授課中予以呈現,以使得修習該課程者,得以全面性掌握醫療問題與醫療糾紛的處理,如何確實保障權利,同時兼顧及病人的最佳利益,以創設醫病和諧的願景。

Teaching objectives: To confirm the rights and obligations of medical treatment and the legal positioning of what is and should be, so that course participants can understand the legal relationships arising from medical treatment. The course is based on medical law. It discusses the issues of medical disputes arising from medical treatment, examines the reasons for the occurrence of medical disputes, reviews the legal relationship of medical accidents, qualifies the liability arising from medical disputes, and analyzes and introduces it. There should be a model for handling medical controversies in order to reduce the disturbance of medical controversies, enable medical staff engaged in medical work to maintain their medical positions with peace of mind, and avoid medical controversies causing crisis awareness in the medical system. Through the understanding of medical dispute issues and the mastery of their handling models, the development and improvement of the medical level can confirm the basic understanding of legal relationships.
Teaching content: 1. Qualitative legal relationship of medical treatment; 2. Overview of medical-patient relationship and legal liability; 3. Legal issues of preventive medical treatment; 4. Balanced relationship between patient autonomy and medical treatment; 5. Medical legitimacy and risks; 6. Prerequisites and legal attributes of specific medical actions; 7. Medical treatment The causes and phenomena of disputes; 8. The legal liability mechanism for medical disputes; 9. The integration of specific case analysis and handling models; 10. Feasible ways to balance medical responsibilities; 11. Analysis of medical dispute litigation and mediation methods; 12. Comprehensive research and judgment on the integration of concepts and individual cases.
The specific content of the lectures is introduced from the topic outline to the specific procedures to be followed, starting from the medical behavior, regardless of actions or inactions, using case guidance, covering the basic requirements of the medical procedure SOP, such as the obligation to inform and specific content, the issue of patient autonomy and medical arbitrariness, the issue of medical criticality, and whether preventive medicine is an umbrella for immunity from legal liability? All issues arising from medical treatment should be presented in courses and practical teaching as much as possible, so that those who take this course can comprehensively grasp the handling of medical problems and medical disputes, how to truly protect rights, and at the same time take into account the best interests of patients, so as to create a vision of harmony between medicine and disease.
