對於刑事程序作為實現刑罰權的正當法律程序,其正當程序的形象與問題所在。從建構正當法律程序的基礎條件,做為檢視現行刑事程序的基礎,比對其他法制類似的制度,以及介紹不同法制體例的運作模式。以使學習者能從既有實然的刑事程序現狀,更深入具備剖析及辯證的思維。分析現有刑事訴訟法規範的問題,透過邏輯思維的辯證模式,導引學生進入獨立思考,同時兼具發掘問題及解決問題的能力。The image and problem of the criminal procedure as a legitimate legal process that implements criminal punishment. From the basic conditions of the formal legal process to construct the basic conditions of the present criminal procedure, we compare the systems similar to other legal systems and introduce operating models that introduce different legal systems. In order to enable learners to have a more in-depth analysis and evidence thinking from the existing real criminal procedure. Analyze the existing criminal complaint regulations, and guide students to think independently through the verification model of logical thinking, while also having the ability to discover and solve problems.
