授課目標:確認醫病的權利義務關係,在法律定位的實然與應然,以使得修習課程者能瞭解醫療所生的法律關係。課程以醫療法為基礎,因醫療所生醫療爭議事件問題的探討,檢視醫療爭議事件發生的原因,檢討醫療事故的法律關係,對於醫療爭議事件所生的責任定性,分析介紹處理醫療爭議事件應有的模式,界以降低醫療爭議事件的紛擾,能使從事醫療工作的醫護人員,安心善守於其醫療的崗位,避免醫療爭議事件造成醫療體系的危機意識。藉以醫療爭議問題的理解,以及其處理模式的掌握,讓醫療層次的發展與提升,能在法律關係上,確認應有的基本認知。
授課內涵:一、醫療的法律關係定性;二、醫病關係與法律責任概述;三、預防性醫療的法律問題;四、病人自主與醫療的平衡關係;五、醫療正當性與風險;六、具體醫療作為的前提及其法律屬性;七、醫療糾紛的成因與現象;八、法律上對於醫療糾紛責任任的機制;九、具體個案分析與處理模式的融合;十、平衡醫療責任的可行性方式;十一、醫療糾紛訴訟與調解方式的剖析;十二、概念與個案融合的綜合研判。
具體授課的內容,係從題綱導入具體應遵循的程序,從醫療行為,不論作為或不作為,採取以案例引導方式,遍及醫療程序SOP的基本要求,諸如告知義務與具體內容、病人自主與醫療專斷問題、醫療臨界的問題、預防性醫療是否為豁免法律責任的保護傘?舉凡醫療所生的諸等問題,儘量於課程及實際授課中予以呈現,以使得修習該課程者,得以全面性掌握醫療問題與醫療糾紛的處理,如何確實保障權利,同時兼顧及病人的最佳利益,以創設醫病和諧的願景。Course objectives: confirm the rights and obligations of medical diseases, and the reality and responsiveness of legal positioning, so that courseworkers can understand the legal relationships arising from medical treatment.
