本課程為商標法及與商標相關之不公平競爭(Unfair Competition)之介紹，以美國商標法原理原則及案例，及我國相關時事、案例為討論主軸，使學生能具備對商標法的基本認識與分析能力。

This course is an introduction to trademark law and the Unfair Competition related to trademarks. It uses the principles and cases of the US trademark law, as well as relevant current affairs and cases in our country as the discussion, so that students can have basic understanding and analysis capabilities of trademark law.

本課程為商標法及與商標相關之不公平競爭(Unfair Competition)之介紹，將採取案例教學法、理論與實務結合教學，而以美國商標法案例的討論為主軸，並將分週次安排專家學者進行專題演講與案例分析。授課的內容主要為：商標權之取得、商標識別性、營業包裝（非功能性、識別性及特殊商標）、商標侵害（認定侵害之參酌因素、侵害之特殊態樣）、輔助侵害與代位責任、商標淡化（「著名」之要求、模糊化與減損信譽）、商標抗辯事由、商標救濟措施以及商標讓與及授權等各項商標法制的議題。希望藉此等商標法議題的介紹與探討，使學生能具備對商標法的研究能力。

This course is an introduction to trademark law and the Unfair Competition related to trademarks. It will adopt case teaching, theory and practice teaching, and focus on discussions on US trademark law cases. Experts will be arranged to conduct topical speeches and case analysis in a timely manner. The contents of the course are mainly: acquisition of trademark rights, trademark identification, business packaging (non-functional, identification and special trademark), trademark infringement (determined infringement, special conditions of infringement), assistance infringement and subrogation, trademark downplay ("famous" requirement, blurring and decree), trademark anti-debt reasons, trademark economic relief measures, trademark entrustment and authorization issues. We hope that through the introduction and exploration of these trademark issues, students can have the ability to research trademark methods.
