法制史是以人類文化、社會法制變遷為研究對象的歷史研究分支，近來人文社會學科之間，跨科技整合形成新趨勢，法學亦不例外。在以往的法學教學內容當中， 教授的重點多著眼於國內實定法律體系與社會的對應關係，而攸關社會變遷的法律與歷史文化的對話以及跨國比較卻少被特別強調。

然而近年研究開始突破既往窠臼，與歷史學互相整合，以國際漢學、文化對話傳播等角度企圖剖析不同文化背景下，社會現象背後的文化內涵，展現新的契機，不只歐美，連東亞各國學者也紛紛著書立說，互相交流研討，而法制史也與聯合國17項永續發展目標的優質教育、性別平等、和平正義與健全的司法等項目息息相關。

法制史涵蓋甚為廣博，常見有中國法制史、台灣法律史、日本法制史、德國法制史、法文化史、法律與文學等等大學部課程，本課程以法社會學、法文化學與歷史學比較研究角度，在有限的課程時數中引領學生思索法律變遷發展之意義、培養學生發展個人觀點， 理解「法律與歷史相同，都是過去、現在與未來的互動」；並經由研習近代以降人類文明的發展與法律思想變遷，建構大學生應具備的世界觀，以迎向新世紀， 充實學生公民素養。

Legal history is a branch of historical research that focuses on changes in human culture and social legal systems. Recently, cross-tech integration has formed a new trend among humanities and social disciplines, and law is no exception. In the previous law teaching content, professors mostly focused on the corresponding relationship between the domestic statutory legal system and society, while the dialogue between law and history and culture and cross-national comparisons related to social changes were rarely emphasized.

However, in recent years, research has begun to break through the past stereotypes and integrate with history. It attempts to analyze the cultural connotations behind social phenomena in different cultural backgrounds from the perspectives of international sinology, cultural dialogue and communication, and presents new opportunities. Not only scholars from Europe and the United States, but also East Asian countries have written books and exchanged discussions with each other. Legal history is also closely related to the United Nations' 17 sustainable development goals such as quality education, gender equality, peace and justice, and sound judiciary.

Legal history covers a wide range of topics, including Chinese legal history, Taiwanese legal history, Japanese legal history, German legal history, legal culture history, law and literature, etc. This course uses the comparative research perspectives of legal sociology, legal culture and history to lead students to think about the significance of legal changes and development in a limited number of hours, and to cultivate students to develop their personal perspectives. Understand that "law is the same as history, both are the interaction of the past, present and future"; and by studying the development of human civilization and changes in legal thought since modern times, construct a worldview that college students should possess in order to welcome the new century and enrich students' civic qualities.

使學生瞭解法制史之意義及重要性，鑑往知來---在以古為鑑下去省思中西法律文化的衝擊，並進而反省如何使法律文化生根。

To enable students to understand the significance and importance of legal history and learn from the past - to reflect on the impact of Chinese and Western legal culture by using the past as a mirror, and then reflect on how to make legal culture take root.
