法制史是以人類文化、社會法制變遷為研究對象的歷史研究分支,近來人文社會學科之間,跨科技整合形成新趨勢,法學亦不例外。在以往的法學教學內容當中, 教授的重點多著眼於國內實定法律體系與社會的對應關係,而攸關社會變遷的法律與歷史文化的對話以及跨國比較卻少被特別強調。
然而近年研究開始突破既往窠臼,與歷史學互相整合,以國際漢學、文化對話傳播等角度企圖剖析不同文化背景下,社會現象背後的文化內涵,展現新的契機,不只歐美,連東亞各國學者也紛紛著書立說,互相交流研討,而法制史也與聯合國17項永續發展目標的優質教育、性別平等、和平正義與健全的司法等項目息息相關。
法制史涵蓋甚為廣博,常見有中國法制史、台灣法律史、日本法制史、德國法制史、法文化史、法律與文學等等大學部課程,本課程以法社會學、法文化學與歷史學比較研究角度,在有限的課程時數中引領學生思索法律變遷發展之意義、培養學生發展個人觀點, 理解「法律與歷史相同,都是過去、現在與未來的互動」;並經由研習近代以降人類文明的發展與法律思想變遷,建構大學生應具備的世界觀,以迎向新世紀, 充實學生公民素養。
Legal history is a branch of historical research that takes the transformation of human culture and social legal system as research objects. Recently, between humanities and social sciences, cross-science and technology integration have formed a new trend, and law is no exception. In previous law teaching content, the professor focused more on the domestically established legal system and society’s relationship, while the dialogue between laws and historical culture that are related to social changes and the transnational comparison is less particularly emphasized.
However, in recent years, research has begun to break through the past stubbornness and integrate with history, analyze the cultural connotation behind social phenomena under different cultural backgrounds from the perspectives of international Han and cultural dialogue, and show new opportunities. Not only Europe and the United States, but also learners from all over the East and Asia have also written books and exchanged and discussed each other. The history of the legal system is closely related to the 17 permanent development goals of the United Nations, including quality education, gender equality, peace and justice, and sound justice.
The history of legal system is very broad. There are often courses in colleges such as Chinese legal system, Taiwan legal history, Japanese legal history, German legal history, legal culture history, law and literature. This course takes the perspective of comparative research on legal society, legal culture and history, and guides students to think about the meaning of legal change and development in a limited number of courses. Understand that "law is the same as history, both the interaction between the past, present and the future"; and through the study of the development of human civilization and the transformation of legal ideas since modern times, university students should have a world view to usher in the new century and fulfill the ritual of students and citizens.
