2019年6月修正刑事訴訟法部分條文，規定檢察官於「偵查中」、法院於「言詞辯論終結前」，經關係人之同意或依其聲請，將案件轉介適當機關、機構或團體進行修復。另外，與引進「修復式正義」(Restorative Justice)，議題相關的重要修法是，刑事訴訟法增訂第七編之三「被害人訴訟參與」（第455條之38至同條之47），賦予一定犯罪之被害人得請求付與卷宗及證物之影本、就審判中之調查證據陳述意見、辯論證據證明力以及就科刑範圍表示意見等參與訴訟之權利。
依修法理由說明，引進修復式正義「旨在藉由有建設性之參與及對話，在尊重、理解及溝通之氛圍下，尋求彌補被害人之損害、痛苦及不安，以真正滿足被害人之需要，並修復因衝突而破裂之社會關係」。惟關於修復式方案的適用範圍、程序要件、實施方式及修復的效力如何等相關機制或配套，卻均未進一步明文規範。可預見的是，委由偵審實務裁量運作的結果，恐將造成適用標準不一、處遇結果不公等現象，而相當程度影響及於被告及被害人的權益，乃至於司法程序公平性及正確性。因此，在法制化之初，針對被害人的參與訴訟機制的檢討，以及修復式方案如何設計，包括其適用範圍、程序要件、實施方式及修復的效力等課題，均有必要從維護正當法律程序、無罪推定及兼顧被害人權益保護的觀點，進行制度論的比較研究與實務運作狀況的觀察檢討。
