刑事制裁長期以來在教學上不受到重視，文獻的探討上亦不如犯罪論汗牛充
棟，屬學術上的死角。然而，刑事制裁係在完成刑事訴訟程序之後的最後階段，也是國家
實現具體刑罰權的表徵，關係到刑罰成效，不可不謂重要。
