教育目標 Course Target

行政法各論業務領域與問題包羅廣泛,但是行政法總論之學習,若未能結合此兩者進行,勢必流於空泛難解。尤其是對於尚未有行政執法實務經驗之學習者,透過實際之個案及執法(行政、司法)實務,檢視相關之行政法學理論及通則性之規定,在學習效果上,益見其重要。也希冀藉由個案之雙向討論,加大討論之深度與廣度,貫徹學問之研究終究回歸問題之解決的要求。當然為提高學習之興趣與問題意識,研討之題目也納入最新之實務發展。首先以新完成之幾篇碩士論文之題目、大綱以及第一章之內容, 引領研究生具體學習學位論文如何撰寫?以及研究之方法等,同時藉這些論文作為授課參考題材,已幫助研究生為畢業研究所做好準備。課程之內容主要包含當前學界關心的熱門議題、行政法院相關之判解與決議之檢討、當前重要之時事案例講授與討論。The various business areas and problems in administrative law are broad, but if the learning of the general discussion of administrative law fails to combine these two, it will inevitably be empty and difficult to solve. Especially for those who have not yet learned the practice of administrative law, it is more important to examine relevant administrative law theories and general regulations through actual cases and legal (administrative, judicial) practices. We also hope to use the dual discussion of a case to increase the depth and diversity of the discussion, and learn the requirements of finally solving the problem by asking questions. Of course, in order to improve learning interest and problem awareness, the research topics also include the latest practical developments. First, with the topics, major issues and contents of the first chapter of the newly completed scholarly essays, the main topics and the contents of the first chapter, we will lead graduate students to write specific academic essays? As well as research methods, etc., and using these papers as reference materials for courses, graduate students have helped prepare for graduate school. The content of the course mainly includes hot discussion issues that are of concern to the academic community, review of relevant judgments and decisions of the Administrative Court, and presentation and discussion of important current cases.
