本學期課程以損害賠償制度為授課之中心，針對臺灣近年來之重要相關裁判進行討論，題材範圍橫跨民法、消費者保護法及醫事法規等，並將適時比較德國法就類似個案之切入觀點和處理模式。藉由具體個案之研讀，進一步觀察理論與實務之互動，思考損害賠償制度於現代風險社會中所扮演之角色，以期深化修習同學對於現行損害賠償制度之認識，並有助於了解國外關於損害賠償法制之發展脈動。This course focuses on the teaching of the damage compensation system, discusses important relevant judgments in Taiwan in recent years, and covers the topics across civil law, consumer protection law and medical law, etc., and compares German law appropriately to the point of view of similar cases. and processing mode. Through the study of specific cases, we can further observe the interaction between theoretical and practical affairs, think about the role of the damage compensation system in the modern risk society, in order to deepen the understanding of the current damage compensation system, and help understand foreign harm The development movement of litigation of the legal system.
