教育目標 Course Target

授課目標:確認醫病的權利義務關係,在法律定位的實然與應然,以使得修習課程者能瞭解醫療所生的法律關係。課程以醫療法為基礎,因醫療所生醫療糾紛問題的探討,檢視醫療糾紛發生的原因,檢討醫療糾紛的法律關係,對於醫療糾紛所生的責任定性,進而倒出處理醫療糾紛應有的模式,界以降低醫療糾紛的紛擾,能使從事醫療工作的醫護人員,安心善手逾期醫療的崗位,避免醫療糾紛造成醫療體系的危機意識。藉以醫療糾紛問題的理解,以及其處理模式的掌握,讓醫療層次的發展與提升,能在法律關係上,確認應有的基本認知。 授課內涵:一、醫療的法律關係定性;二、醫病關係與法律責任概述;三、預防性醫療的法律問題;四、病人自主與醫療的平衡關係;五、醫療正當性與風險;六、具體醫療作為的前提及其法律屬性;七、醫療糾紛的成因與現象;八、法律上對於醫療糾紛責任任的機制;九、具體個案分析與處理模式的融合;十、平衡醫療責任的可行性方式;十一、醫療糾紛訴訟與調解方式的剖析;十二、概念與個案融合的綜合研判。 具體授課的內容,係從題綱導入具體應遵循的程序,從醫療行為,不論作為或不作為,採取以案例引導方式,遍及醫療程序SOP的基本要求,諸如告知義務與具體內容、病人自主與醫療專斷問題、醫療臨界的問題、預防性醫療是否為豁免法律責任的保護傘?舉凡醫療所生的諸等問題,儘量於課程及實際授課中予以呈現,以使得修習該課程者,得以全面性掌握醫療問題與醫療糾紛的處理,如何確實保障權利,同時兼顧及病人的最佳利益,以創設醫病和諧的願景。Teaching objectives: To confirm the rights and obligations of medical treatment and the legal positioning of what is and should be, so that course participants can understand the legal relationships arising from medical treatment. The specific teaching content is introduced from the topic outline to the specific procedures to be followed, from medical behavior, regardless of actions or inactions, to case-based guidance, covering the basic requirements of SOP for medical procedures, such as the obligation to inform and specific content, patient autonomy and medical treatment. 本課程之開設目的有三:第一,引起醫療院所暨其醫事人員,對於醫療法律問題產生興趣。第二,透過分析我國最高法院關於醫療糾紛之判決,掌握實務上之爭議問題。第三、鼓勵醫療院所暨其醫事人員,結合醫學與法律的專業能力,從事科際整合之醫事法學研究。
This course has three purposes: first, to arouse medical institutions and their medical staff to become interested in medical and legal issues. Second, by analyzing the judgments of my country’s Supreme Court on medical disputes, we can grasp practical controversial issues. Third, encourage medical institutions and their medical personnel to combine the professional capabilities of medicine and law to engage in interdisciplinary integrated medical legal research.
