交互詰問為刑事訴訟實務上極為重要之一環,因此,本課程之目標有二:第一、使同學瞭解交互詰問之理論基礎與基本規則;第二、提供交互詰問演練場景,強化交互詰問之基本能力。本課程之內涵在於厚實刑事訴訟之操作技巧,透過交互詰問之演練,親自體會交互詰問理論之實現,亦即「從做中學」,培養訴訟實務之實戰技巧。Cross-examination is an extremely important part of criminal litigation practice. 在美日刑事訴訟採行當事人進行的訴訟構造下,交互詰問乃刑事審判證據調查的重心,係一發現真實之利器的同時,也有助於被告詰問權的保障。近年,隨著我國刑事訴訟當事人主義化的趨勢,交互詰問制度漸受重視,不僅從89年6月起已有士林、苗栗及台北等地院率先實施交互詰問,有關傳聞法則及交互詰問等證據規範已經修法增訂,於92年2月6日公布,且已於同年9月1日起全面施行。
此項修法變革,大幅影響我國刑事審判的法庭活動。為因應此項修法及制度的變革,法律系學生除了修習刑事訴訟法外,有必要針對交互詰問制度本身以及如何實踐、操作詰問技術,修習基礎而必備的知識。本課程內容分兩部分:
第一部分屬制度層面的講解,使修課學生瞭解交互詰問在整個刑事訴訟中的定位,檢察官、法官及辯護人在交互詰問中應有的角色扮演,以及操作交互詰問應有的環境及配套機制。
第二部分,則著重於交互詰問的模擬演練,使學生初步習得交互詰問的順序、詰問的方法及異議的處理等必備的知識。

This legislative change has significantly affected court activities in criminal trials in our country. In response to this legislative amendment and institutional change, law students must acquire basic and necessary knowledge about the cross-examination system itself and how to practice and operate the cross-examination technology in addition to studying criminal procedure law. The content of this course is divided into two parts:
The first part is an explanation at the institutional level, allowing students to understand the position of cross-examination in the entire criminal procedure, the roles prosecutors, judges and defenders should play in cross-examination, as well as the environment and supporting mechanisms for operating cross-examination .
The second part focuses on the simulation exercises of interactive cross-examination, so that students can initially acquire the necessary knowledge such as the order of cross-examination, methods of cross-examination and handling of objections.
