本課程將以我國公平交易法之相關實務案例為研究之對象。
公平交易法的課程一般都是以法條的解釋為核心,受到課程時間的限制往往無法有充足的時間帶領同學閱讀案例,只能擷取判決中具有重要性的判旨,說明實務見解的看法。但判決意旨若與事實完全切割,導出的結論有時也會未臻周全。因此,本課程將帶領對於我國公平交易法有興趣的同學一同閱讀法院判決,藉此觀察法院如何運用公平交易法,與公平會的觀點有何不同、法院所採的見解本身是否合乎邏輯、與過去的法院判斷是否有矛盾之處,應如何將每個判決定位於公平法的法律體系之中。
雖然公平交易法的內容相當深奧,但只要掌握了基本原理入門並不困難,歡迎大學部及研究所同學參加本課程,一起從判決中學習公平交易法的概念。
第一週課程務必出席以便進行課程報告之安排,未出席者視為同意強制退選。This course will take relevant practical cases of our fair trading law as the subject of research.
The courses of fair trade law are generally centered on the interpretation of legal terms. Due to the limitations of course time, we often cannot have enough time to lead classmates to read cases. We can only take the important judgment in the judgment and explain the views on practical explanations. But if the judgment is completely separated from the fact, the conclusions introduced sometimes will not be comprehensive. Therefore, this course will lead students interested in the Fair Trade Law of our country to read court judgments, so as to observe how the court uses the Fair Trade Law, how it is different from the perspective of fairness, whether the court's understanding itself is logical, and whether there is any contradiction with past court judgments, and how each judgment should be positioned in the legal system of the Fair Law.
Although the content of the fair trading law is quite profound, as long as you master the basic principles and enter the door, students from the university and the institute are welcome to participate in this course and learn the concept of fair trading law from the judgment together.
The first week of course must be attended in order to make arrangements for course reporting. Those who do not attend will be deemed to agree to a forced withdrawal.
