本課程將以我國公平交易法之相關實務案例為研究之對象。
公平交易法的課程一般都是以法條的解釋為核心，受到課程時間的限制往往無法有充足的時間帶領同學閱讀案例，只能擷取判決中具有重要性的判旨，說明實務見解的看法。但判決意旨若與事實完全切割，導出的結論有時也會未臻周全。因此，本課程將帶領對於我國公平交易法有興趣的同學一同閱讀法院判決，藉此觀察法院如何運用公平交易法，與公平會的觀點有何不同、法院所採的見解本身是否合乎邏輯、與過去的法院判斷是否有矛盾之處，應如何將每個判決定位於公平法的法律體系之中。
雖然公平交易法的內容相當深奧，但只要掌握了基本原理入門並不困難，歡迎大學部及研究所同學參加本課程，一起從判決中學習公平交易法的概念。
第一週課程務必出席以便進行課程報告之安排，未出席者視為同意強制退選。This course will study relevant practical cases of my country’s Fair Trade Law.
Courses on fair trade law generally focus on the interpretation of legal provisions. Due to course time constraints, there is often not enough time to lead students to read cases. They can only extract important rulings from the judgments and explain practical insights. . However, if the intention of the judgment is completely separated from the facts, the conclusions drawn may sometimes be incomplete. Therefore, this course will lead students who are interested in my country's fair trading law to read court decisions to observe how the court applies the fair trading law, how it differs from the Fair Trade Association's views, and whether the court's opinions are logical and consistent with In the past, courts judged whether there were contradictions and how each decision should be positioned within the legal system of equity law.
Although the content of the Fair Trade Law is quite profound, it is not difficult to get started as long as you master the basic principles. Students from universities and graduate schools are welcome to participate in this course and learn the concepts of the Fair Trade Law from the judgments.
It is mandatory to attend the first week of classes in order to arrange course reports. Those who do not attend will be deemed to have agreed to be forced to withdraw.
