教育目標 Course Target

本課程擬以「修復式正義」或稱「修復式司法」(Restorative Justice)之「刑事司法轉向」新視角,以「被害人訴訟參與制度」為主軸,深入檢討新制對我國刑事訴訟法落實修復式正義之運作影響與未來展望,藉此厚植制度運用之學理基盤乃至於生成有益於將來立法論之多元觀點。並以此新制檢討為基礎,再進一步擴展,將檢討的觸角深入犯罪被害人與刑事司法之各個相關的重要議題。依據新制,特定犯罪被害人,得聲請參與訴訟(新制第455條之38,略記為455-38,以下同。),經法院准許訴訟參與者(455-40),得得隨時選任代理人(455-41),於審判中有卷證資訊獲知(455-42),在準備、審判期日則有受通知及在場權(455-43、455-44),且可對證據調查以及量刑表示意見、並得就證據證明力辯論(455-46、455-47)。由此,不難發現,新制下,我國的被害人訴訟參與人,並非當事人,也並未享有如日本刑事訴訟法所定對檢察官權限行使之表示意見並聽取檢察官說明的權利(同法316-35)亦無詢問證人之權利(同法316-36);而且,也與德國刑事訴訟法所定訴訟參加制度有所不同,亦即,在我國的情形,並沒有對證人及鑑定人提問之權利(同法240),亦無證據調查聲請權(同法244Ⅲ〜Ⅵ),更無獨立救濟權(同法401Ⅰⅰ)。 如上對照以觀,我國新制,與德日相較,似乎顯得有點陽春,那麼,新制,在運作上,究竟能揮發如何效能?也就著實引人興趣了。為此,本課程以「被害人訴訟參與制度」為主軸,設定以下四項檢討課題。 第一課題、刑事程序構造論與被害人主體地位構造論。 第二課題、受律師協助之權利與被害人參與程序。 第三課題、轉向機制與系統性事故之被害人。 第四課題、其他重要議題。 This course takes the new perspective of "criminal justice transition" of "restorative justice" or "restorative justice", and takes "victim's lawsuit participation system" as the main point, and deeply examines the impact and future prospects of the new system on the implementation of the revision of the formal justice of our criminal lawsuit law, so as to strengthen the theoretical basis for the use of the system and even generate diverse views that are beneficial to the legislative discussion. And based on this new inspection, we will further expand the inspection to further deepen the focus of the inspection into important issues related to criminal victims and criminal justice. According to the new system, if the victim of a specific crime is called to participate in the lawsuit (38 of the new system, the record is 455-38, the same as below.), the court allows the participants to file a lawsuit (455-40), and the agent will be selected at any time (455-41), and the case will be held in the trial. Certificate information (455-42), and are notified and on-site at the preparatory and trial date (455-43, 455-44), and can conduct investigations and sentencing opinions, and can also make a statement about the certificate (455-46, 455-47). Therefore, it is not difficult to find that under the new system, the victims of our country who sued the participants, were not parties, and did not enjoy the right to express their opinions on the exercise of the rights of the prosecutor as stipulated in the Japanese Criminal Disclaimer Law and listen to the instructions of the prosecutor (Same Law 316-35) and did not have the right to ask the prosecutor (Same Law 316-36). ); and, in addition, it is different from the system of participation in the lawsuit stipulated in the German Criminal Disclaimer Law. That is, in our country, there is no right to ask the witness and the appraisal (Same Law 240), nor is there any right to investigate the person (Same Law 244Ⅲ~Ⅵ), nor does it have the right to rescue the economy (Same Law 401Ⅰⅰ). As we compare with the above, our country's new system, which is comparable to Germany and Japan, seems to be a little sunny. So, how effective can the new system be in operation? It is actually interesting. To this end, this course focuses on "Victim’s Complaints and System", and sets the following four review topics. The first topic, criminal procedural discussion and the victim's dominant status discussion. The second course is the right to receive assistance from the lawyer and the participation of the victim in the proceedings. The third course topic, the victim of the turnover mechanism and systematic accident. The fourth course and other important topics.
