憲法第十六條規定:「人民有請願、訴願、訴訟之權」,在法治國基本思想之要求下,「有權利必有救濟」之理念深植人心。行政救濟係指人民因行政機關之違法或不當行為,致其權益受損害,而向國家請求申訴之制度。
Article 16 of the Constitution stipulates: "The people have the right to petition, appeal, and litigate." Under the requirements of the basic idea of the rule of law, the concept of "every right must have a remedy" is deeply rooted in the hearts of the people. Administrative relief refers to the system in which people appeal to the state because their rights and interests have been harmed due to illegal or improper acts of administrative agencies.
