在經濟全球化的時代，國際貿易規則也日趨繁複，在分類上更可區分為以規範私人貿易行為之國際貿易私法，以及以管制國家貿易規則之國際貿易公法兩大類。本課程內容將涵蓋三大部分，除了前述之國際貿易私法以及國際貿易公法外，也將涵蓋國際貿易爭端解決處理。針對國際貿易私法部分，本課程將就國際買賣、契約訂定以及爭端解決等議題進行講述，在國際貿易公法部分，則側重於說明世界貿易組織法律規範，除了講述WTO下對貨品、服務貿易以及智慧財產權保護、防衛措施以及補貼之規定外，亦將就當前熱門之CPTPP、TTIP、RCEP等自由貿易協定以及國際投資法規加以介紹。為了培養學生解決並處理國際貿易爭端之基本能力，本課程也將講述國內以及國際貿易糾紛之救濟和爭端解決，以及國際投保協定下對跨國投資之保護與規範。In the era of economic globalization, international trade rules are becoming more and more diverse. In terms of classification, they can be divided into two categories: international trade private law that regulates private trade behavior, and international trade public law that regulates national trade rules. The content of this course will cover three parts, in addition to the aforementioned international private trade law and public trade law, it will also cover the international trade dispute resolution process. In the international trade and private law part, this course will discuss international buying and selling, contractual settlement and dispute resolution. In the international trade public law part, the side focuses on explaining the legal rules of the world trade organization, in addition to discussing the WTO In addition to the provisions on the protection of goods, service trade, smart property rights, prevention measures and supplementary provisions, we will also introduce the current popular free trade agreements such as CPTPP, TTIP, RCEP and other international investment laws. In order to cultivate students' basic abilities to solve and handle international trade disputes, this course will also discuss the economic and dispute resolution of domestic and international trade disputes, as well as the protection and regulations for cross-border investment under the International Insurance Agreement.
本課程以建立學生應對跨國貿易之國際貿易私法規範以及規範各國貿易規則的國際貿易公法有基本知識，能就私人跨國貿易所可能涉及之法律問題進行分析，並了解世界貿易組織（WTO）法律、區域貿易協定以及國際投資法的基本原則，並有處理國際貿易爭議之基本能力。
