本課程之教學目標為以下兩點：1.探討法的本質與法律制度中正義與一般法律原理原則之理論。2.探討司法院大法官之憲法解釋論。主要內容係就司法與裁判之角度，思考權利保障制度與理論相關問題。具體的內容包括權利論、法解釋論、法正義論、司法違憲審查制度等項目。The teaching objectives of this course are the following two points: 1. To explore the nature of law and the theory of justice and general legal principles in the legal system. 2. Discuss the interpretation theory of the Constitution by the Justices of the Judicial Yuan. The main content is to consider issues related to the rights protection system and theory from the perspective of justice and adjudication. The specific contents include the theory of rights, the theory of legal interpretation, the theory of legal justice, the judicial review system of constitutional violations and other projects.
