隨著社會大眾對於維護個人權益之意識逐漸高漲,在醫療領域中出現醫療糾紛之情形並非罕見;而反映在司法實務上,可觀察到醫療訴訟之數量似有逐年增長的現象。此外,在醫療科技不斷向前突破的現在與將來,諸多圍繞著醫學倫理與法律而生之衝突或疑義,早已顯現其有進一步探討之必要性與實益性,故於上揭背景下,醫事相關法規向受醫界、法界及學界之重視。有鑑於醫學與法學交會下所延伸出之相關議題,不僅對於醫事人員、對於病人甚或其家屬之權益亦影響甚鉅,因此本課程擬以全面之視角,系統性地介紹醫事法的各個子領域;並在此基礎上,輔以重要案例來進一步對照、思考理論與實務結合後的運作境況是否切合實際,或猶有待改善之空間,俾使有意願進一步了解此一新興法學領域者,得以認識醫事相關法規之體系、掌握其中之重要概念或爭議所在。As the public's awareness of protecting personal rights gradually increases, it is not uncommon for medical disputes to occur in the medical field; and reflected in judicial practice, it can be seen that the number of medical complaints seems to be increasing year by year. In addition, with the current and future of medical technology, there are many conflicts or doubts born from medical ethics and law, which have long shown that it has the necessity and practicality of further exploration. Therefore, in the context of the above, the relevant laws and regulations of medical affairs are valued by the medical world, the law world and the academic world. The relevant issues extended under the medical and legal exchanges also have a great impact on medical staff, patients and even their families. Therefore, this course systematically introduces the sub-regions of medical practice from a comprehensive perspective; and on this basis, it provides important cases. For example, we can further compare and think about whether the operational situation after the combination of theory and practice is in effect, or regarding the space that needs to be improved, so that those who intend to further understand this new field of jurisprudence can understand the system of medical-related laws and master the important concepts or disputes therein.
