教育目標 Course Target
在全球化的潮流下，跨國訴訟已為法律實務現況常見之型態，台灣在國際貿易之下也時常涉及跨國之訴訟，有鑑於美國民事訴訟程序與台灣民事訴訟程序之區別甚鉅，對於日後不論是從事法學研究或是法律實務，對於美國民事訴訟程序之瞭解已日趨重要。因此本課程以美國聯邦明事訴訟(Federal Rule of Civil Procedure)為主軸，介紹美國聯邦體系之民事訴訟規則，一方面增加同學對美國民事訴訟實務之瞭解，另一方面對於民事訴訟比較法學的研究奠定基礎。同時藉由英文教材之教學也增進同學法學英文之能力。
Under the trend of globalization, transnational lawsuits have become a common type of legal practice. Taiwan often involves transnational lawsuits under international trade. Some are very different from the civil lawsuit procedures in the United States and civil lawsuit procedures in Taiwan. It is increasingly important to understand the civil lawsuit procedures in the United States in the future, whether it is legal research or legal practices in the future. Therefore, this course focuses on Federal Rule of Civil Procedure, introducing the civil litigation rules of the US federal system. On the one hand, it increases the understanding of American civil litigation practices, and on the other hand, it lays the foundation for the research on civil litigation comparative law. At the same time, through the teaching of English textbooks, we also improve our ability to learn English by students.
