Special Study on Criminal Procedure Law
教育目標 Course Target
刑事訴訟法主要的任務，是刑事實體法關於犯罪認定與刑罰制裁的實現，是屬於實現性的程序規範，充分理解刑事程序的規則與要求，是確認實體法實現與法治國思想的首要任務。藉由刑事程序的整體性觀察，以及指導原則的闡明，以住學習者能對於刑事程序有更深一層的體認。而爭議問題者，則是對於現制及制度面的總檢討，以期學生能完全掌握刑事訴訟及司法運作的實然與應然。
The main task of the Criminal Law is the reality of criminal law regarding criminal recognition and criminal sanctions. It is a realistic procedural rule, fully understanding the rules and requirements of criminal procedure, and is the primary task of confirming the reality of physical law and the idea of a rule of law. Through the overall observation of criminal proceedings and the clarification of guiding principles, learners can have a deeper understanding of criminal proceedings. The dispute problem is a general review of the current and institutional aspects, so as to hope that students can fully grasp the reality and response of criminal complaints and judicial operations.
