教育目標 Course Target
本課程以勞動契約相關理論與實務問題作為探討對象,以民法僱傭契約、勞動基準法為主要範圍,希望藉由理論與實務的說明與研究,藉由教導學生適當的研究方法、提供學生對此領域有一全面的認識。
本課大綱如下:前4次由任課老師教授勞工/從屬性的概念、法源/工作規則的相關問題,之後由學生分別口頭報告,在作完第1輪報告後,應參酌老師與同學意見,修正完成第2輪的口頭報告。報告的題目可包括如下範圍:
一、 勞工/從屬性,僱傭/承攬/委任契約的區分,
如:公司法上的經理人/醫師/保險業務員/釋字第740號解釋
二、 雇主/多重雇主
三、 法源/工作規則
四、 雇主的主給付義務/工資/平均工資概念/加班費/相關問題
五、 勞工的主給付義務/服勞務/工作時間(備勤/待命/候傳)/加班
六、 一例一休相關問題
七、 特別休假相關問題
八、 其他約款, 如:調職/離職後競業禁止/定期
九、 雇主其他義務/平等待遇
十、 勞動派遣, 部分工時等
十一、 職業災害補償
十二、 解雇相關問題
十三、 退休相關問題
This course takes the theoretical and practical issues related to labor contracts as the object of discussion, with the civil law employment contract and labor standards law as the main scope. It hopes to provide students with a comprehensive understanding of this field through the explanation and research of theory and practice, and by teaching students appropriate research methods.
The outline of this course is as follows: for the first four times, the teacher will teach the concept of labor/subordination and issues related to legal sources/work rules. After that, students will give oral reports respectively. After the first round of reports, the second round of oral reports should be revised and completed based on the opinions of the teacher and classmates. Report topics may include the following:
1. The distinction between labor/subordination and employment/contract/appointment contracts,
For example: Manager/physician/insurance salesperson in company law/Explanation No. 740
2. Employers/Multiple Employers
3. Source of law/work rules
4. Employer’s main payment obligation/wage/average wage concept/overtime pay/related issues
5. Labor’s main payment obligations/services/working hours (on standby/on call/on call)/overtime
6. Issues related to one case and one break
7. Issues related to special leave
8. Other contractual payments, such as: transfer/non-compete after resignation/fixed term
9. Other obligations of the employer/equal treatment
10. Labor dispatch, partial working hours, etc.
11. Occupational disaster compensation
12. Issues related to dismissal
13. Issues related to retirement
