教育目標 Course Target

本課程以勞動契約相關理論與實務問題作為探討對象,以民法僱傭契約、勞動基準法為主要範圍,希望藉由理論與實務的說明與研究,藉由教導學生適當的研究方法、提供學生對此領域有一全面的認識。 本課大綱如下:前4次由任課老師教授勞工/從屬性的概念、法源/工作規則的相關問題,之後由學生分別口頭報告,在作完第1輪報告後,應參酌老師與同學意見,修正完成第2輪的口頭報告。報告的題目可包括如下範圍: 一、 勞工/從屬性,僱傭/承攬/委任契約的區分, 如:公司法上的經理人/醫師/保險業務員/釋字第740號解釋 二、 雇主/多重雇主 三、 法源/工作規則 四、 雇主的主給付義務/工資/平均工資概念/加班費/相關問題 五、 勞工的主給付義務/服勞務/工作時間(備勤/待命/候傳)/加班 六、 一例一休相關問題 七、 特別休假相關問題 八、 其他約款, 如:調職/離職後競業禁止/定期 九、 雇主其他義務/平等待遇 十、 勞動派遣, 部分工時等 十一、 職業災害補償 十二、 解雇相關問題 十三、 退休相關問題 This course takes the theory and practical issues related to the movement contract as the object of exploration, and takes the civil law contract and the labor-based method as the main scope. It is hoped that through the explanation and research of theory and practice, we will teach students appropriate research methods and provide students with a comprehensive understanding of this field. The course is as follows: The first four times the teacher teaches the worker/the concept of attributes, the source of law/work rules related to the work rules, and then the students report orally. After completing the first round report, they should refer to the teacher and classmates' opinions and correct the oral report of the second round. The topics of the report may include the following scope: 1. The division of the contract of employment/inheritance/appointment, For example: Company law manager/doc/insurance businessman/detailed word number 740 Explanation 2. Employer/multiple employer 3. Law source/work rules 4. Employer's contribution/work/average wage concept/overtime fee/related problems 5. The main contribution of the worker/service/working time (reservation/on standby/waiting for)/overtime 6. One case and one rest related problems 7. Problems related to special leave 8. Other contracts, such as: job promotion/post-leave competition prohibited/regular 9. Employer's other obligations/equal treatment 10. Mobile dispatch, some industrial and commercial periods, etc. 11. Job disaster compensation 12. Dismissal related problems 13. Retirement-related problems
