沒收為刑法新制定的獨立法律效果，其獨立性的基礎，必須符合法律效果的正當性，現行規範仍有缺失。本專題主要是為使研習者能夠充分掌握法律效果的基本概念，同時檢討沒收規範的得失，培養研究生思考及辯證能力。
具體授課內容:
一、刑法法律效果概說
二、法律效果的基礎定性，法律效果產生的根源與正當性。
三、沒收制度的歷史發展與過往未來，從沒收從屬性到獨立性的演變。
四、法律效果的獨立性與從屬性。
五、沒收獨立性的定性。
六、沒收作為獨立效果的規範檢討。
七、沒收效果的實體法上效應與具體運用。
八、沒收效果的程序法實踐
九、綜合檢討。

The independent legal effect of the newly formulated Criminal Law is not lost. The basis of its independence must conform to the legitimacy of the legal effect, and the current practice rules are still missing. This topic is mainly intended to enable researchers to fully grasp the basic concepts of legal effects, and to review the gains and losses of no restrictions, and to cultivate graduate students' thinking and certification abilities.
