教育目標 Course Target
台灣與日本之法學有許多相同的地方，不僅各種法律名稱相同，亦同為大陸法系之國家，因此日本之判例學說有許多值得吾人借鏡之處，本課程以日本之判例學說為中心，詳細解說文章之結構，並討論其內容，以提高研究生之日文法學之能力，提供在撰寫論文時參考日本學說與判例之閱讀能力。由於判例學說範圍廣泛，如憲法、民法、刑法、民刑事訴訟法等皆包括在內，原則上以民法之判例為主要內容，若同學有必要者亦可自行提供相關之學說與判例做為本課程之教材。
Taiwan and Japan have many similarities. Not only are there all kinds of legal names, but they are also countries in the mainland's legal system. Therefore, Japan's precedents have many things worth borrowing from. This course focuses on the Japanese precedents, explains the structure of the article in detail, and discusses its contents, so as to improve the ability of graduate students to study Japanese grammar and provide the ability to read Japanese academics and cases when writing papers. Since the scope of precedent learning is wide, such as the law of justice, civil law, criminal law, civil criminal acts, etc., it is mainly based on the precedent of civil law. If the companion is necessary, you can also provide relevant teaching materials for this course by yourself.
