教育目標 Course Target
台灣與日本之法學有許多相同的地方，不僅各種法律名稱相同，亦同為大陸法系之國家，因此日本之判例學說有許多值得吾人借鏡之處，本課程以日本之判例學說為中心，詳細解說文章之結構，並討論其內容，以提高研究生之日文法學之能力，提供在撰寫論文時參考日本學說與判例之閱讀能力。由於判例學說範圍廣泛，如憲法、民法、刑法、民刑事訴訟法等皆包括在內，原則上以民法之判例為主要內容，若同學有必要者亦可自行提供相關之學說與判例做為本課程之教材。
The jurisprudence of Taiwan and Japan have many similarities. Not only do the names of various laws have the same name, but they are also countries with a civil law system. Therefore, Japan’s jurisprudence has a lot to learn from. This course focuses on Japanese jurisprudence. It explains the structure of the article in detail and discusses its content to improve graduate students’ Japanese jurisprudence ability and provide them with the reading ability to refer to Japanese doctrine and jurisprudence when writing papers. Since the scope of precedent doctrine is wide, including the Constitution, civil law, criminal law, civil and criminal procedure law, etc., in principle, the precedents of civil law are the main content. If necessary, students can also provide relevant doctrines and precedents as the teaching materials of this course.
