民法債編各論共規範數十種有名契約，與吾人日常生活息息相關。本課程在民法總則、債編總論所建立之基礎上，更進一步聚焦於契約法，除依序說明各有名契約之要件及其概念內涵等外，亦將適時針對其間重要之法律爭議為說明，補充學理上對此提出之各家見解、並就相關司法裁判進行討論，以具體觀察實務對於爭議問題之立場為何，俾學生得由全面性之角度切入，認識不同有名契約之面貌，以強化其思辨法律問題及解決實際案例之能力。
