本人近年多次舉辦法律與文學的研討會,並於2007年曾參與教育部補助法學教育改革計畫-法律與文學,皆獲得極大的迴響,本於這門課程一貫精神,就是要透過感性的文學,使過度理性的法律人從中培養人文素養:文學作品的影響,法律人能在文學作品的無限憧憬中,尋找到靈感及努力的方向,且試著使法律論著得到感動人心的力量;更重要的是,從文學領域中得到敏銳與悲憫,並進一步豐富生命,以免得法律人淪為法匠,正如同諾貝爾文學獎得主高行健所言「文學讓人保持人的意識」,這也是本課程最重要的核心之一。
我國的法學教育,最受人詬病的就是,只訓練出一群操作法條的法匠,而不是法律人,此乃因為我國當前的法學教育,忽略人文精神。刑法議題涉及人的生命、身體、自由、財產,若欠缺人文關懷,在處理刑法問題時,將會陷入僅有思維邏輯,而無人性溫暖的冷酷境地,所以,本課程將以法律與文學為中心開展,讓文學的感性,在理性的法律人內心開啟一扇心靈之窗。「法律與文學」的研究,近年來受到西方眾多學者的關注,然而台灣仍屬待開發的領域,認為兩者是互不相干的兩個平行領域。惟法律與文學彼此間並非完全毫不相干,兩者間仍具相當密切的關聯。在相關的研究中,我們可以分為「文學中的法律」、「法律中的文學」兩個領域,「文學中的法律」注重小說及戲劇中對於法律秩序的描寫研究;「法律中的文學」則是運用文學批評與文學理論來解釋法律各項基本原理原則。
據此,透過兩者的結合可以讓法律的解釋不再是枯燥,更富有人文關懷。近來,司法實務最令人詬病的不外乎是其見解與人民普片的觀感差距甚大,更有所謂「恐龍法官」、「恐龍判決」的批評聲浪。觀察我國的法治教育,多注重在法律條文的解釋與邏輯的訓練,鮮少注重人文關懷的層次,透過文學的媒介,不但使法律的學習更加生動,更能因文學的人文特性使學習者除了法律的專業知識外,了解同理心的重要。如此一來,法律的學習不再是巨塔裡的遊戲,而能與社會大眾的觀點趨於一致。In recent years, I have held seminars on law and literature many times, and in 2007, I participated in the Ministry of Education's supplementary legal education reform plan - law and literature, and have all received great remarks. In this course, the spirit of this course is to enable overly rational legal professionals to cultivate humanistic literacy through emotional literature: the influence of literary works, and the infinite number of legal professionals in literary works can be achieved in the literature. In the longing, we will find the direction of our spirit and efforts, and try to make our legal opinions touch the power; more importantly, we will gain insight and grief from the field of literature, and further enrich our lives, so as to avoid legal professionals being wise men. Just as Gao Xingjian, the winner of Nobel Literature Award, said, "Literature allows people to maintain human consciousness", this is also one of the most important cores of this course.
The most illusory thing about our legal education is that we only train a group of lawmakers who operate law rather than legal persons. This is because our current legal education ignores the humanistic spirit. Criminal Law Questions involve human life, body, freedom, and property. If you lack humanistic concerns, when dealing with criminal law problems, you will fall into a cold situation where you only have thought logic and no human nature. Therefore, this course will be centered on law and literature, so that the sensibility of literature will open a window of mind in the heart of rational legal professionals. The study of "Law and Literature" has attracted the attention of many Western students in recent years. However, Taiwan still belongs to the field to be developed, and it is believed that the two are two parallel fields that are irrelevant. However, law and literature are not completely irrelevant, and the two are still closely related. In related research, we can divide it into two fields: "law in literature" and "literature in law". "law in literature" focuses on novels and dramas about the description and research of legal order; "literature in law" uses literary criticism and literary theory to explain the basic principles of various law.
In this way, through the combination of the two, the legal interpretation can no longer be boring, but more humanistic. Recently, the most sensible thing about judicial practice is that the view of the big gap between its perception and the general public, and there are also criticisms about "Judge Dinosaur" and "Judge Dinosaur". Observe our country's rule of law education, pay more attention to the interpretation of legal articles and the training of logic, and pay less attention to the level of humanistic concern. Through the media of literature, not only can the learning of law be more vivid, but also can make the learning of law more vivid because of the humanistic characteristics of literature, learners can understand the importance of empathy in addition to the professional knowledge of law. In this way, the learning of law is no longer a game in the giant tower, but can be consistent with the views of the public.
