教育目標 Course Target

讓學生瞭解政府部門的運作,從而瞭解與第三部門間之關係。憲政體制是憲法規範政治權力運作之模式,各國主要係以分權原則進行權力配置,這些權力配置方式不同,而有各種類型的憲政體制。憲政機關依其不同類型體制所建構的軌道運作,但因為時空環境以及文化上的差異,即使相同類型的國家,往往會有不同的運作經驗,造成運作結果之差異。故研究憲政體制皆從憲法規範入手,再比較各國的運作差異,並且聚焦於行政權與立法權之互動關係上。在憲法規範行政權與立法權相互關係中,不論採何種憲政體制的設計,莫不著力於避免兩權運作時出現僵局。內閣制設計倒閣的機制,維持行政與立法的一體性,總統制則是採用覆議制度,賦予總統有權否決國會通過的法案,以達到權力分立並且使行政權不致於過渡受制於立法權。本課程即在研究行政與立法間之關係。

Let students understand the operations of government departments and understand the relationship with the third department. The constitutional system is a model in which the constitution regulates the operation of political power. Countries mainly allocate power based on the principle of separation of powers. These power allocation methods are different, and there are various types of constitutional systems. Constitutional organs operate according to the tracks constructed by different types of systems. However, due to differences in time, space, environment and culture, even countries of the same type often have different operational experiences, resulting in differences in operational results. Therefore, all studies on constitutional systems start with constitutional norms, then compare operational differences across countries, and focus on the interactive relationship between executive power and legislative power. In the constitution's regulation of the relationship between executive power and legislative power, no matter what kind of constitutional system design is adopted, efforts must be made to avoid deadlock in the operation of the two powers. The cabinet system designs a mechanism for overthrowing the cabinet to maintain the integration of executive and legislative powers, while the presidential system adopts a review system, which gives the president the right to veto bills passed by Congress to achieve separation of powers and prevent executive power from being overly controlled by legislative power. This course studies the relationship between administration and legislation.
