智慧財產法主要包括專利法，商標法，著作權法以及營業秘密法，而企業體在經營上最常觸及的是專利權與商標權的問題，是以其中又以專利法與商標法是最為重要，法律系的學生對該二法不能沒有最基本的理解。另外，目前智慧財產法已成為司法官及律師國考的選試科目之一，因此對於有意參加該等國考的同學對此等法科亦不可忽視。基此，本課程的主要目標有兩個，一個是希望讓修習的同學們對於專利法與商標法的基礎理論有最起碼的理解；另一個是希望讓修習的同學們可以對實務上的運作有基本的概念。Smart property law mainly includes patent law, trademark law, copyright law and business secret law. What enterprises most often touch on in business is the problem of patent rights and trademark rights. Therefore, patent law and trademark law are the most important. Law students cannot have the most basic understanding of the two laws. In addition, smart property law has now become one of the selected subjects for the national examination of judicial judges and lawyers, so students who are interested in taking these national examinations should not be ignored. Based on this, there are two main goals of this course. One is to hope that the students who practice practice have the most advanced understanding of the basic theories of patent law and trademark law; the other is to hope that the students who practice practice can have a basic concept of practical operations.
本課程係在教授智慧財產權法的兩大領域，即專利法與商標法，專利法著重在保護文化的創新，商標法則著重在保護正當競爭交易秩序，是企業經營不可或缺的利器。在時間分配上，專利法約佔總授課時間的3/5，商標法則佔約2/5。在授課內容上除了法規理論的講解外，亦會配合實際案例的說明，使修習者不但可對此兩門法律的規範內容有基本的認識，而且對實務上的操作有一般性的理解。
This course teaches two major areas of intellectual property rights law, namely patent law and trademark law. Patent law focuses on protecting cultural innovation, and trademark law focuses on protecting the order of competitive transactions, and is an indispensable tool for corporate operations. In terms of time allocation, patent law accounts for about 3/5 of the total teaching time, and trademark law accounts for about 2/5. In addition to the explanation of legal and regulatory opinions, the teaching content will also be coordinated with the explanation of actual cases, so that practitioners can not only have a basic understanding of the regulations of these two laws, but also have a general understanding of practical operations.
