程序法為實現實體權利的途徑，民事訴訟法即為解決民事私法上實體權利義務爭議，以兼顧當事人的程序正義為旨而設？因此本課程著重訓練同學以民事實體法為基礎，結合民事訴訟法的程序，以達實現民事實體權利為目的？本課程首先介紹民事訴訟程序的整體進程及目的，然後分別針對民事訴訟從開始？審理到終結所經過的攻擊防禦程序，先解釋程序設立的目的及理論基礎，以實務上的操作及判例為主，期建立學生實體法與訴訟法一貫的體系？另民事訴訟法歷經重大修正，本課程亦著重新舊法的變革，以利同學了解民事訴訟法改革的方向及新舊法的區別︒Is procedural law the way to realize physical rights, is civil litigation law the purpose of resolving the dispute over practical rights in civil private law, and is it established to consider the procedural justice of the parties? Therefore, this course focuses on training students to take civil physical law as the basis and combine the procedures of civil lawsuit law to achieve the purpose of realizing civil physical rights?
