比較民法之研究，除橫向比較我國與其他國家現行民法中具有類似功能的法律制度外，亦可從歷史角度，考察民法概念、制度在各個時代的形成與演變。本學期課程即擬採用歷史的比較方法，研讀晚近相關基本英文文獻，探討現行民法中核心制度（權利主體、家庭、契約、所有權、繼承、侵權行為等）的歷史起源及其主要原理，進一步比較羅馬法與現行歐陸各國與我國民法典中的對應制度，以理解各該制度在歷史發展中的演變軌跡。

Compared with the study of civil law, in addition to comparing the legal systems with similar functions in civil law practiced by my country and other countries, we can also examine the formation and evolution of civil law concepts and systems in various eras from a historical perspective. This course adopts a comparison method of history, study the relevant basic English literature recently, explore the historical origins and main principles of the core systems in the current civil law (rights subject, family, contract, ownership, inheritance, infringement, etc.), and further compare the corresponding systems in the Civil Code of Roman law with the current European and Chinese countries to understand the evolution of each system in the historical development.
