本課程目標有以下三點:
1. 瞭解智慧財產權法之基本體系與理論架構。並培養修課學生從爭議問題中,思考智慧財產權法之範圍與界線。
2. 學習比較法之研究方法。
3. 培養修課學生國際化思考之面向與觀點。本學期專注於智慧財產權之衝突與挑戰。
將選定學者Peter Drahos 之四到五篇著作,進行閱讀與討論,並回歸我國法制檢討與觀察。
特別注意:
1. 本堂課嚴格要求學生積極參與與事前閱讀指定教材。若自認時間無法允許或不願投入心力於課堂活動者,請勿選課,以免影響其他同學學習情緒。
2. 本堂課將大量閱讀英文文獻,歡迎同學挑戰。本學期選定之學者Peter Drahos為國際知名智財學者,文章精彩且深負啟發。願意花時間閱讀絕對會對法學推理及縝密思考有絕佳助益。
3. 本堂課本學期不限定討論專利、商標或特定智財議題(專利議題102下學期已討論,商標103, 104下學期已討論,著作權議題請修胡心蘭老師開設之著作權法專題研究)。將著重於智慧財產權理論與歐洲相關規範。會於進行比較研究時,適時提到美國法相關規範,但若僅對美國法有興趣者,請勿修習本科目。
4. 本堂課會於檢討著作時,回歸我國法制進行檢討比較,但並非我國智慧財產權法課程講授。關於智慧財產權基本部分,同學必須自行閱讀。若僅為準備國家考試,請勿選修本堂課。The purpose of this course is as follows:
1. Understand the basic system and theoretical structure of the smart property rights law. And train students to think about the scope and boundaries of the wisdom of property rights in the dispute.
2. Learn the research method of comparative method.
3. Cultivate students' international thinking and perspectives. This period of study focuses on conflicts and challenges in smart property rights.
The four to five works of selected scholar Peter Drahos will be read and discussed, and will be reviewed and inspected by our legal system.
Special attention:
1. This class strictly requires students to actively participate in and read the designated textbooks in advance. If you cannot allow time or are unwilling to devote yourself to class activities, please do not choose classes to avoid affecting the learning conditions of other students.
2. This class will read a lot of English language and welcome students to challenge. Peter Drahos, the selected scholar in this period, is an internationally renowned intellectual financial scholar. His articles are wonderful and deeply rooted in development. Being willing to spend time reading will definitely be of great help to legal reasoning and intensive thinking.
3. This class does not limit the discussion on patents, trademarks or specific intellectual finance issues (the patents, trademarks, or specific intellectual finance issues have been discussed in the second period, trademarks, 103, 104 have been discussed in the second period, and copyright issues are discussed in the second period. Please review the copyright issues developed by Teacher Hu Xinlan). It will focus on the intellectual property theory and European relevant regulations. When conducting a comparative study, it is appropriate to mention the relevant regulations of American law, but if you are interested in American law only, please do not practice this subject.
4. When reviewing works, this class will return to our country's legal system for review and comparison, but it is not taught in our country's Wisdom Property Rights Law course. Regarding the basic part of smart property rights, students must read it by themselves. If you are only preparing for national exams, please do not choose to take the class in this classroom.
