本課程目標有以下三點：
1. 瞭解智慧財產權法之基本體系與理論架構。並培養修課學生從爭議問題中，思考智慧財產權法之範圍與界線。
2. 學習比較法之研究方法。
3. 培養修課學生國際化思考之面向與觀點。本學期專注於智慧財產權之衝突與挑戰。
將選定學者Peter Drahos 之四到五篇著作，進行閱讀與討論，並回歸我國法制檢討與觀察。

特別注意:
1. 本堂課嚴格要求學生積極參與與事前閱讀指定教材。若自認時間無法允許或不願投入心力於課堂活動者，請勿選課，以免影響其他同學學習情緒。
2. 本堂課將大量閱讀英文文獻，歡迎同學挑戰。本學期選定之學者Peter Drahos為國際知名智財學者，文章精彩且深負啟發。願意花時間閱讀絕對會對法學推理及縝密思考有絕佳助益。
3. 本堂課本學期不限定討論專利、商標或特定智財議題(專利議題102下學期已討論，商標103, 104下學期已討論，著作權議題請修胡心蘭老師開設之著作權法專題研究)。將著重於智慧財產權理論與歐洲相關規範。會於進行比較研究時，適時提到美國法相關規範，但若僅對美國法有興趣者，請勿修習本科目。
4. 本堂課會於檢討著作時，回歸我國法制進行檢討比較，但並非我國智慧財產權法課程講授。關於智慧財產權基本部分，同學必須自行閱讀。若僅為準備國家考試，請勿選修本堂課。

The objectives of this course are as follows:
1. Understand the basic system and theoretical structure of intellectual property law. It also trains students to think about the scope and boundaries of intellectual property law from controversial issues.
2. Learn the research methods of comparative method.
3. Cultivate the international thinking aspects and perspectives of course students. This semester focuses on the conflicts and challenges of intellectual property rights.
Four to five works by scholar Peter Drahos will be selected for reading and discussion, and they will be reviewed and observed by returning to my country's legal system.

Special attention:
1. This class strictly requires students to actively participate and read the designated teaching materials in advance. If you feel that your time cannot allow it or you are unwilling to devote yourself to class activities, please do not choose courses to avoid affecting the learning mood of other students.
2. This class will involve reading a lot of English literature, and students are welcome to challenge. The scholar selected for this semester, Peter Drahos, is an internationally renowned intellectual and financial scholar with excellent and inspiring articles. Being willing to take the time to read will definitely be an excellent help for legal reasoning and careful thinking.
3. This class is not limited to discussing patents, trademarks or specific intellectual property issues this semester (Patent Topic 102 will be discussed in the next semester, Trademark 103, 104 will be discussed in the next semester, and copyright topics please take the special topic study on copyright law taught by teacher Hu Xinlan). The focus will be on intellectual property rights theory and relevant European norms. When conducting comparative research, relevant norms of American law will be mentioned when appropriate. However, those who are only interested in American law should not take this course.
4. This class will return to my country's legal system for review and comparison when reviewing works, but it is not a course on my country's intellectual property law. Regarding the basic parts of intellectual property rights, students must read it on their own. Do not take this course if you are only preparing for the national exam.
