Overview Practices on Criminal Law: General Principles

教育目標 Course Target

本課程主要目標在於:(1)提升以刑法總則為主的案例解決能力,使理論能獲得運用;(2)複習過去刑法總則所學,兼顧理論與實務的內容;(3)利用案例營造學習刑法熱忱,培養自主學習及練題。
本課程主要內涵在於:法律學是具有應用性的社會科學,同學們除了瞭解法規範的內涵之外,更應能正確運用法律,此是法律學系的主要教學任務之一。在司法實務上,遭遇的問題都是以個案實例的樣態呈現;因此,法律實務工作者,無論是法官、檢察官、律師或其他從業者,都必須將抽象的、理論的法律,以合乎論理的方法,運用至實際案例。事實上,大學法律教育中的案例演練,就是在培養未來法律實務工作者的此項能力。是故,本課程以「案例演練」為的主要內涵,其目的就在於,使同學們能夠利用過去刑法(尤其是總則)的所學,解決刑法個案疑難。為使同學們能夠進入案例演練的狀況,原則係以單元方式進行授課,於課程同時,對於過去所學進行複習,並透過演練讓同學們知道自身刑法知識的欠缺之處,而有機會加強。更重要的是,希望案例演練能引發同學們的學習興趣,讓同學能夠優游於刑法學之中。

The main goals of this course are: (1) To improve case-solving abilities focusing on the general principles of criminal law so that theories can be applied; (2) To review what has been learned in the past about the general principles of criminal law, taking into account both theoretical and practical content; (3) To use cases to create enthusiasm for learning criminal law and cultivate independent learning and practice.
The main connotation of this course is: Law is an applied social science. In addition to understanding the connotation of legal norms, students should also be able to apply the law correctly. This is one of the main teaching tasks of the Department of Law. In judicial practice, problems encountered are presented in the form of individual cases; therefore, legal practitioners, whether judges, prosecutors, lawyers or other practitioners, must apply abstract and theoretical laws to actual cases in a logical and logical manner. In fact, case practice in university legal education is to cultivate this ability of future legal practitioners. Therefore, the main content of this course is "case practice", and its purpose is to enable students to use what they have learned in the past criminal law (especially the general principles) to solve difficult criminal law cases. In order to enable students to enter the situation of case practice, the principle is to teach in a unit manner. At the same time as the course, students will review what they have learned in the past, and through practice, students will know the shortcomings of their criminal law knowledge and have the opportunity to strengthen it. More importantly, I hope that the case drill can arouse students' interest in learning and enable them to explore criminal law.
