國際貿易因買賣雙方分處異國,貨物之交付除另有約定外,通常只賣方在約定期限內將貨物運上運 輸工具,及視為已履行交貨義務,而非指將貨物運抵進口地交給買方。國際貿易最被使用的單證(文件)為船運之海運提單(Marine B/L),空運之空運提單(Air way bill),陸運之陸運提單(Way bill)等,然而交付的單證(依據契約規定而有不同)主要是提供給買方證明取得貨物權利所需要的文件。
因此,國際貿易在買賣雙方履約過程將大大增加糾紛或違約事件,如何讓學生經由本課程之教授與實務個案討論中學習到如何預防貿易糾紛之發生或對已發生之貿易糾紛如何因應與解決,為本課程之最主要目標,課程內涵亦是以此目標為主軸所設計,讓學生在討論中學會最實務的解決方案。International trade is a foreign country for buying and selling, unless otherwise agreed, the delivery of goods is usually only the seller transports the goods on the transport tool within the agreed period and is deemed to have fulfilled the delivery obligation, rather than referring to the delivery of the goods to the buyer at the import location. The most used certificates (document) for international trade are Marine B/L, Air Way Bill, etc. However, the delivery certificate (varies according to the contract) mainly provides documents required to obtain goods rights to the buyer.
Therefore, the international trade will greatly increase disputes or contracts during the performance of the two-party contracts in the buying and selling process. How to learn from the professor and practice case discussion of this course to prevent trade disputes or how to respond and solve trade disputes that have occurred is the main goal of this course. The connotation of the course is also designed with this goal, so that students can learn the most practical solutions in the discussion.
